Divorce in UAE – Conditions in The Marriage Contract

A marriage contract follows a standard format almost anywhere, including in the UAE. However, it’s essential to consider special conditions, especially where matters like divorce come into play. Divorce in the UAE is a complicated and sensitive matter, like in other countries where it is legal. Like always, it should respect the rights of both parties, depending on what’s stated in the marriage contract. In most cases, conditions are designed to be in more favor of the wife, who typically gets additional rights.

If you are getting married and want to avoid problems in the case of a divorce, it’s best to consult with a family lawyer to draft your marriage contract effectively. The contract could contain a special condition where the wife can petition for divorce in the UAE alone, but only if her husband marries another person before she passes away. In some cases, a wife may be entitled to more Mahar or the dowry, which can be defined in a specific number of gold coins or high cash value. That is usually considered favorable to maintain a good reputation and standing in one’s community.

The best way to deal with divorce in the UAE is with a skilled and knowledgeable family lawyer. Mahar is usually a motivation for women to get married, so the marriage contract must contain special conditions that will allow or disallow access to the dowry. Some women would tend to file for divorce sooner than expected to obtain it. This could result in extensive issues to the husband who must pay for the dowry being demanded by his wife, and that right of the wife cannot be waived easily. Keep in mind that it can only be waived with written consent from the wife.

Be sure to hire a reputable and experienced lawyer to help you with your marriage contract and lay out the conditions for divorce in the UAE. They can also help you understand complex laws surrounding your circumstances, such as Law No. 28 of the 2005 Personal Status Law.
